By registering to bid and/or placing a bid, you agree to be bound by these terms and conditions. SKE Auctions LLC dba MNauction dba Ediger Auctions (“Auctioneer”) reserves the right to update these terms at any time by posting revisions on this website. Each auction may include additional specific terms listed in the auction details.

Everything is sold AS-IS with no warranties or guarantees. By bidding on this auction you agree that it is your responsibility as the buyer to determine the condition, authenticity, and value of an item. We recommend that you attend the public inspection. If you are unable to attend and would like more information about a particular item please contact our office at 952.322.9199 during the scheduled inspection period to be transferred to a staff person on site. 

Auctioneer will do its best to accurately describe items but makes no representations. Under no circumstances shall Auctioneer be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Auctioneer will not be responsible for any errors or omissions in the description of the merchandise. Bidders shall be the sole judge of value. 

Auctioneer is providing internet bidding for this auction. This service may or may not function properly at the close of the auction. Under no circumstances shall a bidder have any kind of claim against Auctioneer or anyone else if the internet service fails to work correctly during the close of the auction. Auctioneer is not responsible for missed bids or inaccurately entered bids.

Online-only auctions feature extended bidding. When a bid is placed within the last 2 minutes of an item closing, the lot will automatically extend to 2 minutes remaining. This will continue indefinitely until no bids are placed for 2 full minutes. The pace and closing of a Simulcast auction (Live and Online bidding) is determined by the live auctioneer calling the bids. This moves faster than an online-only auction, so bid early and often. Any live audio provided is for entertainment purposes only. Audio streams may experience delays and should not be relied upon for timing your bids.

A buyer’s premium applies to all purchases. The percentage is variable and will be listed in the Auction Details for each auction.

Auctioneer reserves the right to reject any and all bids at its discretion, and to withdraw or re-catalog items. If a refund is ever given for any reason, it shall not exceed the purchase price of the lot. Auctioneer employees and related parties may bid in the auction. Each registered account is considered a bidder once registered, and all registered bidders are treated the same with equal opportunity to bid and purchase.

Bidders are responsible for maintaining the confidentiality of their accounts, including passwords. Any and all activity conducted through a registered account shall be the responsibility of that bidder. When using the website bidders must comply with all local, state, and federal laws. Violations may result in termination of bidding privileges.

Payment is due at the conclusion of posted checkout time. Accepted payment methods include cash, check up to $3,000 payable to MNauction, wire transfer with an additional $25 fee, or credit card with a 4% convenience fee. Sales tax applies where required by law. Adjustments to tax may be made at settlement if exemption forms are properly completed. For any cash transactions exceeding $10,000, Auctioneer is required by the Internal Revenue Service to complete and file IRS Form 8300. “Cash” includes currency, cashier’s checks, money orders, and certain other instruments as defined by federal regulations.

If a check or ACH payment is returned for insufficient funds, stop payment, redeposit, or for any other reason, additional fees may be charged including but not limited to $25 for stop payment or redeposit and $50 for a returned item. In the event of non-payment Auctioneer reserves the right to repossess purchased property at any time and any location.

Items must be removed during the posted pickup window stated in the auction details. Buyers are responsible for loading and securing purchases. Auctioneer staff may assist at the buyer’s request, but Auctioneer is not responsible for damage to property, vehicles, or items during loading. All risks of loading and transport rest with the buyer. Items left behind may be subject to disposal fees.

Shipping for small items is available through our Pack & Ship Service. Buyers must indicate shipping request in the post-auction email from Shipping Saint. After payment is made, Auctioneer will pack items and send a separate shipping invoice. Once the shipping invoice is paid, items will be shipped. Shipping costs include carrier rates through USPS, UPS, FedEx, or Speedee, plus materials and labor. Estimates are available upon request.

SKE Auctions LLC dba MNauction dba Ediger Auctions is a licensed motor vehicle dealer, Minnesota Dealer’s License Number DLR101422. A $90 document fee will be charged for all motor vehicles. A $50 document fee will be charged for trailers, snowmobiles, ATVs, and boats. A $20 document fee will be charged for vehicles being junked. As a licensed dealer, SKE Auctions will process all title and registration paperwork in accordance with Minnesota law. The buyer must provide the driver’s license of the person(s) whose name the title will be transferred into. Buyers must sign all required forms at checkout. Titles will be mailed or delivered once processing is complete. Any known delays will be disclosed in the auction catalog. Applicable sales tax, title, license, and registration fees will be collected at the time of settlement.

Purchases not paid for or not picked up by the end of scheduled checkout will be considered in default. Auctioneer may charge the card on file, including buyer’s premium, convenience fees, and late or transfer fees. Auctioneer may also declare items forfeited and resell them without refund, and may block the bidder from future auctions.

All disputes shall be settled in McLeod County, Minnesota. By bidding, you agree to hold SKE Auctions LLC dba MNauction dba Ediger Auctions harmless from any and all claims related to the auction, purchase, or use of items.
